Immigration and customs enforcement (ICE) y la dualidad de la justicia migratoria en los Estados Unidos

Resumen

Este artículo analiza la configuración del Estado Dual de Fraenkel en los Estados Unidos durante el actual mandato de Donald Trump (2026). El objetivo de esta investigación es analizar cualitativamente la Orden Ejecutiva 13768 y la Proclama 10886, junto con las acciones letales contra inmigrantes y la violación de sus derechos humanos fundamentales. El análisis de estas órdenes ejecutivas a la luz de los conceptos de Fraenkel permitió una comprensión académica de este fenómeno. Dicha articulación teórica dio paso a determinar la diferencia sustancial entre lo que el autor denomina Estado Normativo que corresponde a la legitimidad constitucional de cualquier Estado nacional y el Estado de Prerrogativa, mediante el cual una postura político-ideológica puede llevar a la vulneración de derechos fundamentales. Este último se sostiene jurídicamente bajo el derecho administrativo, donde las actuales medidas del régimen de Trump, justificadas bajo la idea de la “seguridad nacional”, vulneran directamente los derechos humanos internacionales de los inmigrantes en los Estados Unidos.
